Local political subdivisions are not required to adopt the Procurement Code in order to purchase materials and supplies off of a State Contract, as the Public Bid Law, specifically R.S. 38:2212.1(F), already provides such authority to purchase off of existing State contracts.
If purchasing off of State contract, the political subdivision should document in its contract files that it is purchasing off of a State contract, including the applicable contract number and that the item purchased is identical to the one under the State contract. This documentation can include adoption of an ordinance or resolution or inclusion of the decision in its minutes.
