The Public Bid Law exception for the purchase of used fire and emergency vehicles (R.S. 38:2238, et seq.) only applies to emergency response vehicles purchases as at a cost of less than $100,000. According to the facts presented, this fire truck is $100,000. Therefore, the exception does not apply and the Fire District in Louisiana will have to proceed with the ordinary requirements of the Public Bid Law for the purchase. The Fire District in Texas can submit a bid to sell their truck to the Fire District in Louisiana, but they cannot be given the exclusive right to sell the truck to the Fire District in Louisiana.
