It is very difficult for a vendor to be a true sole source and that the Public Bid Law does not provide for sole source procurements. However, a public entity purchasing software may want to review R.S. 38:2234 as well as the LLA's Public Bid Law FAQ - Question 66 on the Political Subdivisions Telecommunications and Data Processing Procurement Act. The District may want to consider using the RFP process outlined therein to purchase the software.
R.S. 39:1410.60(C)(1) provides that local entities do not require approval for Bond Commission for “lease of movable or an installment purchase agreement financing the purchase of a movable if the lease or installment purchase agreement contains a nonappropriation clause, and does not contain an anti-substitution or penalty clause." If the entity while utilize bonds or other instruments to finance the purchase, Bond Commission approval will still be necessary.
