No. The nephew of a public servant is not included within the enumerated list of individuals that constitute the immediate family of the public servant.
Immediate family under R.S. 42:1102(13) is limited to the following:
· The spouse of the public servant (husband/wife);
· The children of the public servant (son/daughter);
· The spouses of the children of the public servant (son in law/ daughter in law);
· The siblings of the public servant (brother/sister);
· The spouses of the siblings of the public servant (brother in law/ sister in law);
· The parents of the public servant (father/mother); and
· The parents of the spouse of the public servant (father in law/ mother in law).
The nepotism policies of a public entity may, however, provide for additional individuals within their restrictions.
