Whether a public entity pays employees monthly or bi-weekly is a policy decision, both of which are acceptable. However, the Attorney General (AG) has stated that payment of compensation in advance is an unconstitutional donation in violation of Article VII, ยง14 of the Louisiana Constitution. See AG Op. No. 01-113 and AG Op. No. 89-0594. Therefore, the clerk should not pay the December payroll in advance.
