Yes, absent advice of the Board of Ethics to the contrary, any individual, compensated or not, who is employed by a governmental entity, supervised by a government official or public employee, or who performs a governmental purpose meets the definition in R.S. 42:1102 of a public employee for the purposes of the Code of Government Ethics.

Public Employees, unless specifically exempted by law, are required by R.S. 42:1170 to receive at least one hour of Board of Ethics approved ethics training per calendar year.

The employee or the commission should consult with its legal counsel and possibly seek an ethics advisory opinion if they believe that an individual should not be considered a public employee or that an exemption from the annual training requirement may apply.
