R.S. 40:1798 provides for the procedures for disposal of firearms seized by or forfeited to law enforcement agencies, including municipal police departments.

Subsection G of this Statute authorizes law enforcement agencies to utilize the same procedures in disposal of the department’s surplus firearms.

The police department should work with its legal counsel to ensure that it complies with any requirements mandated by R.S. 40:1798 for the method of disposal utilized.

Article VII, §14(E) of the Louisiana Constitution also provides that the police department may donate its surplus firearms to another law enforcement or public safety agency that is a political subdivision of the State, e.g. Sheriff, other municipal law enforcement, etc.
