The answer to this question depends on how the specific library/board is set up through the law (constitution, statute and ordinance). Usually, the governing authority of a parish has general power over the library board pursuant to La. Const. Art. VI, Sec. 5. The general power and duties of the library board are specifically set out in the law at R.S. 25:215, et seq. The library board in most cases acts as an agency of the parish with the police jury/council retaining general fiscal control. However, the law enumerates at least 17 specific areas in which a library board may have fiscal or financial authority that surpasses that of the police jury/parish. The library board’s attorney should review the law and AG Op. No. 16-0163 in light of the specific facts to determine the relationship between a specific library board and parish.
