
The District may disqualify a contractor from bidding on the project as “non-responsible," using the procedures set forth in R.S. 38:2212(X).
Those procedures include:
1. Giving written notice of the proposed action to such bidder and include in the written notice all reasons for the proposed action.
2. Within 5 days of written notice, give the bidder, who is proposed to be disqualified, the opportunity to be heard at an informal hearing to refute the reasons for the proposed action.
Disqualifying as non-responsible can be done before each project, to prevent the contractor from being a potential bidder, or the District may elect to see if the contractor bids and/or is the lowest bidder and only go through the process to disqualify then.
