Art. XII, Sec. 6 of the La. Constitution prohibits local political subdivisions from conducting raffles/other games of chance for fundraising. See, AG Op. 10-0125. Therefore, the fundraising cannot include a raffle.

As to the donations of the food items for the fair, Art. VI, Sec. 23 of the La. Constitution allows political subdivisions to accept donations. As the Mayor/village would be soliciting donations from local businesses, many of whom may be vendors for the village or otherwise prohibited sources (i.e., regulated by the village), this may raise issues with the Code of Ethics.

The village could partner with the tourist board or a local nonprofit and have the tourist board/nonprofit solicit donations of food from the local businesses. Furthermore, partnering with a local nonprofit may also allow for a raffle, if the nonprofit has or is able to obtain a charitable gaming license.
