Answer


The Attorney General has noted that in order to piggyback off of an existing contract, the contract must have been let by another Louisiana political subdivision. Therefore, unless another exception is applicable, the city would have to follow the public bid law in making any purchase.

Exceptions that might apply include:
  • If the Office of State Procurement has adopted the national group’s contracts as a State contract or if there are State contracts with similar items, then the City could piggyback off of the State contract and purchase without bidding out the purchases; or
  • If the purchasing group is on the Federal General Services Administration lists, the city can purchase without bidding only if:
    o The items purchased are not available cheaper on an existing state contract, and
    o The purchase is made through a Louisiana licensed dealer or distributor.
    The City should contact the Office of State Procurement to determine if the items to be purchased are available on State contract.
