This is a related party transaction – the library board member should have disclosed that she served on the nonprofit’s board before the vote to donate the property was taken.
Whether this is also an ethics violation depends on the board member’s participation in the vote. That is, if the board member recused himself/herself from the vote on whether to donate the property to the nonprofit in accordance with R.S. 42:1120, then it does not appear to be an ethics violation. The Board of Ethics would ultimately have to determine if an ethics violation occurred.
