
No, in order for a Louisiana public entity to purchase off an existing contract without bid, the contract must have been originally been bid under Louisiana Law. AG Op. No. 15-0018.
A public entity may purchase off an existing contract in lieu of bidding in the following circumstances:
1. The contract is a State Contract. The Office of State Procurement has authority to adopt an existing out-of-state contract as a state contract if it chooses to do so;
2. The contract is on the Federal GSA lists;
- Item must not be available cheaper on State Contract; and
- Must use a Louisiana Licensed Dealer or Distributor.
3. The contract was originally bid by a Louisiana public entity and the requirements of R.S. 38:321.1 are complied with.
- Public Entity who originally bid must certify in writing;
- Must be within 1 year of the opening of bids for the original contract; and
- May not purchase more than 2x the amount procured in the originally bid contract.
