Answer


The Village may not donate the old motors to the neighboring village. Donation of public property, even property that only has scrap value, is prohibited under Art. 7, Sec. 14 of the Louisiana Constitution.

The Village may, however, enter into a CEA with the neighboring village pursuant to the Local Services Law (. R.S. 33:1321, et seq. ) to transfer ownership of the motors without any of the requirements of advertising/bids as would typically be mandated with the sale of surplus property. (See, R.S. 39:1703, which allows the sale of surplus property between two public entities to be made without following the provisions of the Public Bid Law or the Procurement Code).

To start this process, the Village should still declare the property surplus. The Village should also receive Fair Market Value (FMV) for the property. This may be money, services or public benefit, but it must be detailed in the CEA.
