
R.S. 13:1874 provides for the general salaries of municipal court judges.
R.S. 13:1874.1 provides that the salary of a municipal court judge shall not exceed the salary of the district court judge for the district in which the municipality lies.
R.S. 13:1875 provides an exception to the general salary rules for specific municipal courts.
The Attorney General noted in AG Op. No 11-0082 that a municipal court, whose salary is specifically provided for under R.S. 13:1875, is not subject to the general prohibition against exceeding the district court judges’ salary cap.
Given the minimal guidance on this matter, any municipal court whose judge’s salary is provided for under R.S. 13:1875 should consult with the Judicial Commission and the AG prior to providing a salary in excess of their local district court judges’ salaries.
