The purchase of Computer software is "materials and supplies" according to the Attorney General. See AG Op. No. 04-0264. If the price is over $60,000, the purchase must be bid out under the Public Bid Law.


An alternative procurement method may also be found under the Telecommunication and Data Processing Procurement Law at R.S. 38:2234 through R.S. 38:2237. Political subdivisions can utilize a Request For Proposals (RFP) for procurement of data processing equipment, related services or software. Thirty days’ notice is required, published twice in a local newspaper with written notice of the RFP sent to known providers under this law.


Finally, if there is an existing State contract that meets their needs, they can use it to purchase equipment with no further bid.


The installation of the software, connectivity to or for, support or maintenance of software would be a contract for services, not subject to Public Bid Law. (Note that under the Telecommunication and Data Processing Procurement Law, equipment and services are combined and the political subdivision has reasonable discretion in selecting the provider, no lowest bidder requirement.)


The public entity should utilize an RFP or Request for Qualifications (RFQ) process in selecting a contractor for stand alone contracts for professional installation services.
