A.1. Residency in this state is not a requirement for a person to make a public records request. R.S. 44:31 provides that any person of majority may inspect, copy, or reproduce any public record and that any person may obtain a copy or reproduction of any public record. The only limitation in the law is found at R.S. 44:31.2 which limits the definition of person to exclude individuals in custody after sentencing following a felony conviction who has exhausted his appellate remedies if the request is not limited to grounds upon which the individual could file for post-conviction relief under Code of Criminal Procedure Article 930.3.

A.2. If the record requested is immediately available and not in active use, the custodian shall produce the record upon request. However, if the record is in active use (and therefore not immediately available) the custodian must reply within three business days, in writing, to the requestor, informing them of that fact and giving them a date and time as to when the record will be available.

A.3. Personal identifiable information in the traffic ticket reports (such as telephone numbers, street addresses and email addresses) may be subject to privacy concerns under the Louisiana Constitution and, if so, should be redacted from the reports before being turned over as part of a public records request. The entity should work with its attorney in order to make this determination.
