The Attorney General has stated that the council/board “has the power over the fisc of the municipality.” AG Op. No. 12-0074 & AG Op. No. 11-0084. As such, the financial records of the municipality cannot be withheld from them. Therefore, while members of the council have the same right to make public records requests as any other members of the public (See, AG Op. No. 10-0049), requests for financial records by the council are not “public records requests” and should be provided to assist the council in fulfilling its duties.
