When spending federal funds, local entities must follow both the State and Federal procurement rules. Piggybacking is an exception to the State Public Bid Law, but the Federal rules (2 CFR 200) require open competition. Unless the District receives approval, in writing, from the Federal funding agency to piggyback off of the neighboring district’s contract, the District should go out to bid for the equipment. This will ensure that the “open competition” requirement of the Federal rules are met.
