The Attorney General (AG) has noted that public entities in Louisiana may not piggyback on contracts of out of state cooperatives, such as Sourcewell, which were not bid out under Louisiana’s Public Bid Law.

However, the AG has noted that if the Office of State Procurement (OSP) adopts the contract as a State contract, a political subdivision may then purchase off of the contract without following the Public Bid Law.

The OSP has adopted five of Sourcewell’s contracts as State contracts; however, the contract in question has not been adopted by OSP.

The Parish may consider contacting OSP to see if they will adopt the contract or if there are other State contracts available at a lower price. Unless OSP adopts the Sourcewell contract as a State Contract, the Parish cannot purchase off of the contract without complying with the Public Bid Law.
