Response No. 1 - While there is no specific statutory definition of “public funds,” the Attorney General in AG Op. No. 09-0156 provides an illustrative definition of Public Funds which provides guidance in defining “public funds.”

According to the AG, items within the definition of “public funds” include, but are not limited to:

· Any funds obtained from legislative appropriation or any form of State and local taxation;

· Judicial expense funds;

· Self-generated funds;

· Funds of Federal, State, local, parish or municipal governments;

· Revenue or money of a governmental body;

· Securities of a State or national Government; and

· Any other sources of public funds

Response No. 2 - The terms “public funds” and “assistance” are not the same. While items defined at “assistance” under R.S. 24:513(A)(1)(b)(iv) include items that are public funds, the term public funds is much broader than those included or excluded in the statutory definition of “assistance” under R.S. 24:513.
