Unlike with contracts under the Procurement Code, which generally limits the term of contracts to three (3) years or less, there is no statutory limit on public bid law contracts for purchases of materials and supplies.
According to the Attorney General (AG) in AG Op. No. 96-0169 while there is no explicit limit on the term of public bid law contracts, a reasonableness test should be applied regarding the term of the contract. Reasonableness will be a fact specific inquiry and may vary depending on the nature, cost, and type of contract in question.
Ultimately any contract would still be subject to any specific laws restricting or governing the contracting by the public entity or any internal policies established by the public entity in regards to purchasing of materials and supplies or contracting in general.Louisiana Legislative Auditor website: 06/06/2026 08:00:43 PM |
