The Open Meetings Law, in R.S. 42:16, provides that a vote of two-thirds of the members of the public body present is required to enter into executive session. The minutes should reflect the motion to enter into executive session clearly stating the authorized purpose for entering into executive session along with the two-thirds vote of the board members present.
The Open Meetings Law, R.S. 42:19(A)(1)(b)(ii)(cc), requires an unanimous vote of board members present in order to take up a matter that was not on the posted agenda. The public body should ensure that public comment is allowed on the motion to add the item to the agenda
