The municipality/police department cannot accept a donation on behalf of a third party, such as a charity or other non-profit. They may accept restricted donations as long as they serve a public purpose. Once the check was deposited in the municipality's General Fund, it became public money and must be used only for a legal purpose that the police department is authorized to undertake.
In the future, the municipality/Police Department may wish to construct a Cooperative Endeavor Agreement (CEA) "justifying" the public purpose and benefit that will come from work they will perform with the non-profit entity utilizing the donated funds.
