While political subdivisions are not prohibited from utilizing volunteers, a municipality should discuss the matter with its legal counsel to discuss issues regarding liability, access to confidential and sensitive data, and the Code of Governmental Ethics.

The municipality may also want to discuss AG Op. No. 12-0044 and AG Op. No. 09-0062 with its legal counsel. In AG Op. No. 12-0044 the Attorney General discusses potential liability issues in utilizing citizen volunteer assistance, granting access to sensitive and confidential information, and in regard to the role of the council vs executive officer in authorizing volunteers. In AG. Op. No. 09-0062, the Attorney General discusses liability issues in using volunteers for demolition and clean up duties.
