R.S. 33:1321, et seq. (the local services law) authorizes a political subdivision to sell its movable property to another public entity without a public auction through an intergovernmental agreement (IGA/CEA).
Although provisions for Levee Districts usually come in Title 38, the AG has applied the local services law to them as well, as they are a “political subdivision.” See, AG Op. No. 95-0228.
Additionally, R.S. 38:2212.1(D) specifically provides that the public bid law requirements for the procurement of materials and supplies “shall not apply to a public entity purchasing surplus materials and supplies from another public entity . . .”
Therefore, as long as the District sells the tractor to the town at Fair Market Value (money, services and/or other goods), they can enter into an IGA/CEA without doing a public auction, etc.Louisiana Legislative Auditor website: 04/02/2026 12:47:06 AM |
