1.The School Board can dispose of the surplus property in accordance with the procedures under R.S. 33:4712 or R.S. 49:125. As a school board, they need to adopt a resolution declaring the property surplus and setting the minimum value of the property and how they will dispose of the property (private sale, auction, etc.). They must receive Fair Market Value (FMV) for the sale of the property.
2. If they want to sell the property to another political subdivision, they still have to go through the steps of declaring the property surplus, but the method of sale would be the local government services law, R.S. 33:1321, et seq. They would enter into an intergovernmental agreement or CEA with the other school board for the sale. The Board still must receive FMV.
