It appears from the facts stated that 501(c)(3) funds are not intended for legal defense so there may be an issue that the people who gave their “donations” to the Fireman’s fund probably did not think they were giving it to a legal defense fund.
The Board of the 501(C)(3) is tasked with oversight of the proper use of these funds and should adhere to using them as intended. The Fire District should not spend any funds on legal defense without consulting with its attorney or the Attorney General.
