
A.1. La. R.S. 33:5151 provides for the general authority of local political subdivisions to contribute toward the insurance premiums for their employees. The statute does not limit the amount of the premium the local political subdivision can pay (i.e, it can be up to 100%). The statute does not distinguish between full-time or part-time employees. See, AG Op. No. 12-0072.
The District can provide health insurance coverage to the analysts it wants to hire for this special project. To do so, the District must amend its current written policy to include health insurance coverage for this position.
A.2. As to effect of providing health insurance to the analysts on other part-time workers, the Attorney General has stated that providing insurance for some types or class of workers but not other of the same type/class could open the entity to a discrimination claim. See, AG Op. No. 07-0005 and AG Op. No. 05-0049.
Therefore, in order to determine whether the District providing health insurance to the part-time temporary analysts also requires it to provide health insurance to its part-time seasonal truck drivers, the District should work with its attorney to determine whether the analysts and truck drivers are the same type or class of workers.
