The problem with this scenario is that such a transaction may violate Ethics Rule R.S. 42:1113. Public servants are forbidden from entering into contracts and/or transactions with their agencies. There are some exceptions to this rule, at R.S. 42:1123, but this type of sale of equipment to the employee's agency does not appear to fall into any of those exceptions. The District should contact the Ethics Board before taking any action on this issue.
