There does not appear to be any prohibition against the fire chief stating that the funds are to being provided only for repairs and maintenance of the fire trucks. The department should then expend the funds for the lawfully donated purpose.

The fire chief may not, however, place any conditions on the donations that could cause the funds to revert back to the chief or cause the transfer to never occur, i.e, the chief would be prohibited from placing a condition that the money will be returned to the fire chief if not expended by a certain date, or that the money will only be provided if a specific condition occurs.
