A governmental entity (defined as a health care facility owned and operated by a political subdivision of the state) may donate unused prescriptions to a charitable pharmacy per the strict requirements of R.S. 37:1226.2.
Any person or entity, regardless of how it is defined, may donate unused prescriptions to charitable pharmacies. There is no restriction on who may donate, only to whom they may donate to, charitable pharmacies.
There is an exclusion for controlled substances. Federal law does not allow controlled substances to be donated. They must be disposed of as required by federal law. All state and federal laws regarding controlled dangerous substances must be complied with by participating pharmacies.
