A.1. The Public Bid Law requires that the bids be opened publicly. It does not require that the bids be opened at an open meeting of the governing authority. That is, the opening of bids can be done at its own public hearing without the necessity of a quorum of the board being present. However, there is no prohibition against making the opening of bids an agenda item at the board meeting as long as the advertisement states that date and time of the meeting.
A.2. The Attorney General has stated that when a contract is a mix between materials and supplies and services, the entity must determine what is the predominate component of the contract. From the facts presented, it appears that the analysis the data captured by the camera is the predominate component of the contract. Therefore, it appears this is a contract for professional services.
