Article VII, §14 of the Louisiana Constitution prohibits the gratuitous donation of public property. The Parish can do 1 of 2 things. First, the Parish may wish to declare the property surplus pursuant to R.S. 33:4711 and then enter into an intergovernmental agency agreement with the other parish pursuant to R.S. 33:1321, et seq. (the local services law which authorizes a political subdivision to sell its movable property to another public entity without a public auction). The Parish must receive something of value for the exchange. Second, the Parish may wish to enter into a Cooperative Endeavor Agreement (CEA) with the other Parish pursuant to R.S. 33:4712.18, (enacted in the 2017 session) which authorizes the sharing of equipment between public entities “without having to expend funds for such use.” This provision does require a CEA outlining the obligations of the parties.
