The Public Bid Law does not allow waiver of any provisions of the law or of those requirements stated in the bid documents. In this case, the Buy American certification form does not appear to be a required “bid document” and the City did not require the bidders to sign the certification form, but merely included it in the bid packet. And, in fact, neither of the bidders who responded did sign the form. Therefore, the City can award the bid to the apparent low bidder.
