On August 1, 2022, the Public Bid Law threshold was raised from $30,000 to $60,000. R.S. 38:2212.1 (as amended by Act 204 of the 2022 Regular Session). If the truck is $30,000 or more but less than $60,000, the District may purchase it without having to let it out for bid, as long as it receives three documented quotes. If the truck is $60,000 or more, given the circumstances, the District may wish to consider using the Emergency procedures contained in R.S. 38:2212(P) of the Public Bid Law for the limited purpose of declaring an emergency for the purchase of the truck. This procedure requires the District to publish the declaration within 10 days in the official journal.

The District should make sure to document the supply chain issues that have created the need for this declaration and that it has exhausted all other avenues to purchase the trucks in another way (state contract issue, no bids received when let out for bid, lack of viable contract to piggyback, etc.).
